Law No. (71) of 2025 represents a significant development in debt collection in Kuwait, introducing procedural reforms designed to accelerate financial claims and strengthen the protection of creditors’ rights. The amendments reflect Kuwait’s commitment to creating a more efficient judicial system that supports commercial stability and enhances the country’s investment environment.
One of the most significant changes introduced by the law is making the Payment Order procedure the mandatory legal route for written and undisputed monetary claims. Previously, creditors often had to pursue ordinary court proceedings, which could take considerably longer. Under the new framework, creditors can obtain an enforceable order more quickly, provided the statutory requirements are satisfied.
The law also reduces delays by limiting challenges to a grievance (objection) filed within ten days from the date the Payment Order is served. If no grievance is submitted within this period, the Payment Order acquires the force of a final judgment and becomes immediately enforceable. This significantly limits delaying tactics and enables creditors to recover outstanding debts more efficiently.
